By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

 

Product Descriptions

1. We strive to ensure that our products are described as accurately and up to date as possible on our website. Where we become aware of the need to update a description, we reserve the right to do so at any time.
2. Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour, nor that any given image will reflect or portray the full design or options relating to that product.

 

Our Website Services

1. Our products are for sale to adults over the age of eighteen (18) years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.
2. We endeavour to ensure that our product list is current, however we give no undertaking as to the availability of any product advertised on our website.
3. All prices are in Australian Dollars (AUD) and are GST inclusive. We reserve the right to amend our prices at any time.
4. Packaging and postage is an additional charge, calculated at the time of purchase in accordance with your address for delivery.
5. When you order from us, we require you to provide your name, address for delivery, email, telephone contact and credit card details. We undertake to take due care with this information. However in providing us with such information, you accept that we are not liable for its misuse due to an error in transmission, virus or malware.
6. We undertake to accept or reject your order within 3 days. If we have not responded to you within 3 days, your offer is deemed to be rejected. We are not required to give a reason for rejecting your offer to purchase, however the most likely reason is that we do not currently have that product in stock.
7. Once you have submitted an order, you may not cancel your order (even if our acceptance or rejection of your offer is still pending).
8. Legal title to all products purchased on this website passes to you when we receive payment ("Product Sale"). By purchasing, you agree that the relevant Product Sale is to be taken to have occurred and the sales contract formed in Australia and is to be governed by the laws of Australia, notwithstanding the location in which you reside or are located at the time you place your order or make your payment. Following the Product Sale, the transportation of your ordered product to your address for delivery is undertaken by the transportation carrier acting as your agent ("Delivery"). For the avoidance of doubt, Product Sale or Delivery shall not be construed or interpreted as creating any agency relationship between The Gut Co and any person, including you.
9. Delivery of your ordered product will be as set out on our website. Our terms of payment are set out on the order page. 
10. All risk of loss or damage to your ordered product passes to you when we despatch the product.

 

Registered users

1. In order to access certain services provided on this website, such as special offers or subscriptions, you must become a registered user. You must complete the registration process by providing your information, as set out on our registration page. Please refer to our Privacy policy for information relating to our collection, storage and use of your personal information.
2. You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details from time to time when they change.
3. On registration, you will be required to provide a password and you agree to pay for our services, as set out on our website. 
4. We reserve the right to suspend or terminate your access to all or any part of our website at any time, including your registration, if you breach these terms and conditions or we believe in our reasonable opinion that you are misusing our website.

Order Cancellation Due To Error

1. Where a product has been listed at the incorrect price, with incorrect descriptive information or image due to a typographical error, or with a similar oversight, we reserve the right to cancel your transaction. 
2. Where your credit card has been charged, we will immediately refund your credit card for the total amount debited.

 

Product Returns

1. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
1. to cancel your service contract with us; and
2. to a refund for the unused portion, or to compensation for its reduced value.
2. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
3. We undertake to replace any product delivered to you that is faulty or is in a damaged condition.
4. If you wish to return a faulty or damaged product, you must notify us through our designated “contact us” webpage, where we set out our requirements relating to return of such goods.
5. If we are unable at the time of return to replace or exchange the returned goods, we undertake to reimburse your credit card for the amount initially debited for the purchase, including packaging and postage charges.

Jurisdiction

If necessary, the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

The Gut Cø mobile message service (the "Service") is operated by The Gut Cø (“The Gut Cø”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By providing us with your mobile number, or by making a purchase on our site, you agree to receive recurring SMS/text messages from and on behalf of The Gut Cø through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialling system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include sales, promotions, specials, and other marketing offers (e.g., abandon cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with The Gut Cø. Your participation in this program is completely voluntary and you may opt out at any time.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to The Gut Cø or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other The Gut Cø mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Sales Terms and Conditions

Please note the following terms and conditions in the event of a sale where either individual products are discounted, there is a percentage-off, or when consumers are provided with a coupon code. The coupon code and/or discounted product cannot be combined with any other offer, promotion, product bundle, or additional coupon code. If free shipping is available, it will be provided through standard shipping services.
